First Party Property Damage Claims
Since 2010, Feiler Leach & Chong and its attorneys have handled thousands of property damage claims on behalf of property owners and have litigated several claims to verdict. The Firm’s attorneys have successfully represented clients on a wide array of claims— from those involving damages to a single tile in the property, to more complicated claims involving damages in excess of $10 million to more than fifty buildings. To date, the Firm’s attorneys have handled a variety of property damage claims stemming from windstorms, collapses, theft or vandalism, plumbing leaks, tornados, and/or lightening strikes. This list is not finite. Certain policies, known as “all risk” policies, cover any cause of loss as long as such cause is not explicitly excluded under the policy.
The Firm is familiar with a multitude of property insurance policies and can quickly determine whether you have a viable property damage claim. Third Party Property Damage Claims
While first party property insurance claims arise from claims placed by an insured with its own insurance company, third party property insurance claims occur when a property owner who is NOT an insured requests that a third party place their insurer on notice of property damages caused by the third party. A first party insurer has a contractual relationship with the damaged property owner. A third party insurer does not. Mila Lopata, P.A. handles third party property damage claims against third parties where such third party has damaged someone’s else’s property. A typical scenario that occurs in this context is when a property owner retains a contractor to perform renovations to their property, but the contractor in the course of construction, damages the property in a manner not contemplated by the contractor’s scope of work. When this occurs, the property owner may have recourse against not only his or her own property damage insurer, but may also be able to recoup damages from the contractor’s liability insurance company.
